Protect Arizona NOW Officers File Motion to Intervene in Prop200 Lawsuit

Tucson attorney Ed Kahn filed a motion, brief, and related documents yesterday to intervene on behalf of Protect Arizona NOW Chairman Kathy McKee and Treasurer Claudia Bloom in the lawsuit MALDEF has filed in U.S. District Court challenging Proposition 200.  Stated McKee, "Our brief filed in this lawsuit provides irrefutable evidence that PAN, as the originator and sponsor of The Arizona Taxpayer & Citizen Protection Act, is not only willing but also most able to protect the interests of the majority of Arizonans who worked for, voted for, and support Prop 200.  As an unincorporated committee, it appears that PAN itself cannot intervene, so as its sole statutory offices, Claudia and I have petitioned the court to be allowed to intervene as defendants along with the Governor, Attorney General, and Secretary of State."
Kahn states that he plans to argue in court that, "People who sneak across our borders are trespassers.  The law of trespassers is very clear—Trespassers have no legal rights whatsoever, except for whatever rights or privileges the owner of the property being trespassed upon, to wit—the people and government of the United States, choose to give them."
     McKee states, "All Prop 200 does is require people to prove their eligibility.  We're so glad Mr. Kahn has returned to Tucson and can resume representing Protect Arizona NOW.  He's got a great legal team to lead. With his extensive knowledge of and experience in constitutional law, Arizonans couldn't be luckier to have him at the helm of our legal team.  An amicus curiae brief being filed this week by a foundation on our behalf also provides clear and convincing evidence that our opponents don't have a legal leg to stand on.  Justice and the implementation of Prop 200 should be just around the corner!"
